Most consumers purchase and use products without ever considering that they could harm them. However, defective products harm many consumers each year.

Defective products

When a person is harmed by a defective product, he or she may have a claim under product liability law. The product’s manufacturer may be held responsible as well as a party who assembled the product or even the retail store who sold the product to the consumer.

Defective products can include dangerous toys and baby items, food involved in a recall, toxic chemicals in a product, dangerous vehicle defects and dangerous drugs, as well as many others.

There are generally three categories of product defects. There could be a defect in the product’s design, manufacturing or marketing.

Class action lawsuit

When many people are affected by a defective product, they may consider filing a class action lawsuit. A class action lawsuit groups people with a similar concern against a common defendant.

Before the class action lawsuit can move forward, the court will need to approve it. The person who is representing the class must demonstrate that his or her injuries are the same as the other people’s injuries in the class, it must be possible to identify all of the potential members of the class and it must be shown that the class action would be the most efficient way to resolve the concern, among other requirements.

An experienced class action attorney can help consumers affected by defective products and pursue a class action lawsuit on their behalf.
