When are employees victims of disability discrimination?

There are many people in North Carolina who suffer from various disabilities. These could be physical disabilities or mental disabilities. These disabilities affect people in different ways though. It could affect one’s legs, arms, their ability to sit or stand for long periods of times, vision, hearing and other aspects of their body. The disabilities will affect peoples lives in different ways depending on the disability, but many do not prohibit people from being able to complete tasks either on their own or with some assistance.

This means that they can do the same jobs as people without disabilities if they receive a little assistance. In fact employers are required to provide reasonable accommodations to people with disabilities to allow them to do their jobs. As long as the employee is a person with the required experience, education, job skills and other required qualifications can perform the job with reasonable accommodations, employers must provide them.

Reasonable accommodations

Reasonable accommodations include acquiring or modifying equipment to allow people to perform job tasks; granting more unpaid leave; restructuring work schedules; providing interpreters; modifying training or policies and other accommodations. Employers do not need to provide accommodations that create an undue hardship on the company. Whether it creates undue hardship depends on the type of accommodation, cost, size of the company and their resources and other factors.

If employers in North Carolina decide not to hire, fire, demote or take other adverse actions against people with disabilities they may be forced to compensate the disabled employee for their disability discrimination. This compensation could include back pay, future pay and other damages the victims may suffer depending on the circumstances.
