Class actions provide important protections for groups of victims who have suffered similar injuries. There are also important requirements associated with class action protections which is why victims should be familiar with what a class action lawsuit is and the protections it provides.

What is a class action lawsuit?

A class action lawsuit is a legal protection for victims who are injured by the same action or product and sue the negligent party responsible as a group. Examples of injuries that may be included in a class action lawsuit include those caused by defective products such as pharmaceutical drugs, medical devices, motor vehicles and other consumer products. In addition, a class action lawsuit could include victims of consumer fraud, securities fraud, corporate misconduct and prohibited employment practices.

Opting into a class action lawsuit

In some circumstances, the injuries suffered by an individual victim may not be considered enough to bring a personal injury claim for damages but as a class, the damages may be significant. The court must certify the class of victims who are considered similarly situated to file a class action lawsuit. There are notice requirements and victims will need to opt in or opt out, however, they may not be able to opt out in some circumstances.
